Man and Van Isleworth Service Terms and Conditions

These Terms and Conditions set out the basis on which Man and Van Isleworth provides man and van, removals, collection, delivery and related services. By making a booking, using our services or allowing work to commence, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

1.1 Company, we, us, our means Man and Van Isleworth, the provider of removal and transport services.

1.2 Customer, you, your means the person, firm or organisation that books or uses our services.

1.3 Services means any man and van, house move, office move, collection, delivery, loading, unloading, packing, transportation or related services provided by us.

1.4 Goods means the items and property that you ask us to move, transport, handle or store.

1.5 Service area means the local and wider areas in which we agree to operate, including but not limited to Isleworth and surrounding districts, subject to our confirmation at the time of booking.

2. Booking Process

2.1 You may request a quotation by providing accurate information about the locations, access, type and quantity of Goods, dates, times and any special requirements. Quotations are based on the information supplied and are subject to adjustment if that information proves to be inaccurate or incomplete.

2.2 A booking is only confirmed when we have accepted your request, provided a price, and you have expressly agreed to that price and these Terms and Conditions. We may confirm the booking verbally or in writing, including by electronic means.

2.3 It is your responsibility to provide correct addresses, dates, times and contact details, and to inform us promptly of any changes. Changes may affect availability and pricing.

2.4 We reserve the right to decline any booking request at our sole discretion and without giving a reason, for example where access is unsafe, the work is outside our normal service area, or the Goods include prohibited items.

3. Services and Access Requirements

3.1 We will provide the Services with reasonable care and skill, using suitably qualified personnel and vehicles appropriate to the work.

3.2 You must ensure that we have suitable and safe access to the collection and delivery addresses. This includes arranging any necessary parking, permits, lift access, keys, codes or entry instructions in advance.

3.3 Any delays caused by inadequate access, waiting for keys, lack of parking or similar issues may result in additional charges based on our standard hourly or fixed-rate pricing structure.

3.4 We do not dismantle or reassemble items unless this has been expressly agreed at the time of booking. Where we do so at your request, it is at your risk and may incur additional charges.

3.5 Certain items may require special handling or additional labour, such as pianos, safes, large appliances or fragile items. You must inform us of such items in advance so that we can confirm whether we are able to move them and what charges will apply.

4. Quotations and Pricing

4.1 Quotations may be provided on a fixed-price or hourly-rate basis. The quotation will specify the charging method, estimated duration and any additional services included.

4.2 Quotations are based on normal access conditions, reasonable walking distances, typical traffic for the time of day and the information you provide. The price may be adjusted if the work takes longer or is more complex than anticipated due to circumstances beyond our control.

4.3 We may charge extra for:

a. Waiting time due to delays in gaining access or the Goods not being ready.

b. Additional journeys, stops or changes to the route requested by you.

c. Handling items that are significantly heavier or bulkier than disclosed.

d. Work outside normal working hours, where agreed.

4.4 Unless stated otherwise in writing, quotations do not include insurance for high-value items, packing materials, packing services, dismantling or reassembly, storage, or disposal of items.

5. Payments

5.1 We may require a deposit or full prepayment to secure your booking. The amount and due date will be confirmed at the time of booking.

5.2 Any balance due must be paid in full on completion of the Services, or earlier where stipulated. We accept payment by methods confirmed at the time of booking. Cash payments may only be accepted where this has been agreed in advance.

5.3 If payment is not received when due, we reserve the right to:

a. Suspend or withhold services.

b. Retain Goods on the vehicle or in storage until full payment is received.

c. Charge reasonable interest and administration fees on late payments.

5.4 If we have agreed to invoice you, payment terms will be as stated on the invoice. Time for payment shall be of the essence.

6. Cancellations and Amendments

6.1 You may cancel or amend your booking, subject to the provisions of this clause.

6.2 If you cancel more than 7 days before the agreed start time, any deposit paid may be refunded at our discretion, less any non-recoverable costs.

6.3 If you cancel within 7 days but more than 48 hours before the agreed start time, we may retain all or part of your deposit or charge a cancellation fee up to a reasonable proportion of the quoted price.

6.4 If you cancel within 48 hours of the agreed start time, we may charge up to 100 percent of the quoted price to cover our costs and loss of opportunity to book other work.

6.5 If you fail to be present, fail to provide access, or are not ready for us to start work at the agreed time, this may be treated as a late cancellation and charges may apply.

6.6 We may need to reschedule or cancel the Services due to events beyond our control, such as vehicle breakdown, severe weather, illness or other operational issues. In such cases we will aim to offer an alternative date or time. Our liability will be limited to refunding any payments you have made for services not provided.

7. Customer Responsibilities

7.1 You are responsible for:

a. Packing your Goods securely, unless packing services have been agreed.

b. Ensuring all boxes and containers are adequately sealed and strong enough to hold their contents.

c. Labeling fragile or high-value items clearly, and advising us of any special handling requirements.

d. Removing and safely disconnecting appliances before we arrive, unless we have agreed otherwise.

7.2 You must not ask our staff to carry out any work that is unsafe, illegal, beyond the scope of the Services, or likely to damage the vehicle or premises.

7.3 You must ensure that children, pets and other persons are kept clear of the working area for safety reasons.

8. Items We Cannot Move

8.1 We do not transport dangerous, illegal or unsuitable items, including but not limited to:

a. Explosives, flammable or hazardous materials, compressed gases or chemicals.

b. Illegal substances, stolen goods or items obtained unlawfully.

c. Live animals, unless specifically agreed and compliant with relevant regulations.

d. Perishable food items likely to deteriorate during transit.

8.2 If we discover such items during loading or transit, we may refuse to move them, unload them at your risk, or involve the relevant authorities if required by law.

9. Waste and Disposal Regulations

9.1 We are not a general waste carrier and will only remove items for disposal where this has been expressly agreed as part of the Services and is compliant with applicable waste and environmental regulations.

9.2 Any items that you ask us to dispose of must be lawfully disposable household or office items, free from hazardous materials. We reserve the right to refuse items that are not suitable for standard disposal.

9.3 Where we agree to remove items for disposal, additional charges will apply based on weight, volume, type of items and any relevant disposal fees. These charges will be confirmed or reasonably estimated in advance.

9.4 We will take reasonable steps to ensure that waste is transferred only to authorised disposal or recycling facilities in accordance with applicable regulations.

10. Liability and Limitations

10.1 We will take reasonable care of your Goods while they are in our possession. However, our liability is subject to the limitations set out in this clause.

10.2 We will not be liable for loss or damage arising from:

a. Your failure to pack Goods properly, unless we have provided a full packing service.

b. Inherent defects or vulnerabilities in items, such as fragile materials, weak joints or pre-existing damage.

c. Normal wear and tear, minor scuffs or scratches that may occur during handling or transport.

d. Circumstances beyond our reasonable control, including accidents, severe weather, road closures or criminal acts of third parties.

10.3 Our liability for loss of or damage to Goods, whether arising in contract, tort or otherwise, shall be limited to a reasonable cost of repair or replacement, up to a maximum total amount which will be notified to you on request or at the time of booking. You are responsible for arranging additional insurance cover if you require a higher level of protection.

10.4 We will not be liable for any indirect or consequential loss, including loss of profit, loss of income, loss of business, or loss of opportunity, arising out of or in connection with the Services.

10.5 Where we have been negligent and that negligence has caused personal injury or death, nothing in these Terms and Conditions shall limit or exclude our liability to the extent it cannot be limited or excluded by law.

10.6 You must inspect the Goods as soon as reasonably practicable after completion of the Services and notify us promptly of any apparent loss or damage. Any claim must be made in writing within a reasonable period from the date of the move, providing full details and evidence.

11. Delays and Time Estimates

11.1 Any dates, times or durations we provide for arrival, completion or transit are estimates only and are not guaranteed, unless we have expressly agreed to a fixed timeslot in writing.

11.2 We will not be liable for delays caused by traffic, road works, accidents, weather, access difficulties or other circumstances outside our reasonable control.

11.3 You are responsible for making any necessary arrangements with landlords, estate agents, buyers, sellers or other parties to allow for reasonable flexibility in timings on the day of the move.

12. Insurance

12.1 We may hold insurance cover appropriate to the nature of our business. Details of our standard cover, including any limitations or exclusions, are available on request.

12.2 It is your responsibility to arrange additional insurance for valuable items or where the potential loss exceeds the limits of our liability or insurance cover.

13. Complaints

13.1 If you are dissatisfied with any aspect of the Services, you should raise the issue with the driver or team leader as soon as possible on the day so that we have an opportunity to resolve it.

13.2 If the matter is not resolved, you should submit a written complaint within a reasonable time, providing full details of the booking, the issue and any loss or damage claimed.

13.3 We will investigate complaints fairly and aim to respond within a reasonable timescale. Our decision will be based on the evidence available and these Terms and Conditions.

14. Privacy and Data

14.1 We will collect and use your personal data only for the purposes of providing our Services, handling bookings, managing payments, and meeting our legal obligations.

14.2 We will take reasonable steps to keep your data secure and will not share it with third parties except where necessary to deliver the Services, process payments or comply with the law.

15. Termination

15.1 We may terminate a booking or stop work immediately if:

a. You fail to pay any amount due.

b. You act in an abusive, threatening or unsafe manner towards our staff.

c. The working conditions are unsafe or unlawful.

d. The Goods include prohibited or dangerous items.

15.2 In such cases, you may still be liable for all or part of the agreed charges, including any additional costs incurred by us.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them, the Services or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.

17. General Provisions

17.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17.2 Our failure or delay in exercising any right or remedy shall not constitute a waiver of that or any other right or remedy.

17.3 These Terms and Conditions constitute the entire agreement between you and us in relation to the Services and supersede any prior understandings or agreements, whether written or oral.

17.4 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that booking and any related Services.
